1.   

The Advisory Committee (11 Member States) agrees with the Commission that the conduct covered by the draft decision constitutes anti-competitive agreements or concerted practices that infringe Article 101(1) TFEU and Article 53(1) of the EEA Agreement.

2.   

The Advisory Committee (11 Member States) agrees with the Commission’s assessment in the draft decision as regards the duration of the infringement.

3.   

The Advisory Committee (11 Member States) agrees with the Commission that the infringement should be ordered to be brought to an end (insofar as it has not already ended), as set out in the draft decision.

4.   

The Advisory Committee (11 Member States) agrees with the Commission that a fine should be imposed on the addressees of the draft decision.

5.   

The Advisory Committee (11 Member States) agrees with the Commission on the final amount of the fine based on the 2006 Guidelines on the method of setting fines pursuant to Article 23(2)(a) of Regulation No 1/2003, including the reduction of the fine for one of the Parties on the basis of paragraph 35 of the said Guidelines.

6.   

The Advisory Committee (11 Member States) recommends the publication of its Opinion in the Official Journal of the European Union.
